IMPORTANT NOTICE

If you live in the United States, these Terms include a binding arbitration agreement and a class action waiver that affect your legal rights. Please read the DISPUTE RESOLUTION section carefully.

FoxStoria Application, also known as "The Storytimes" ("FoxStoria", "The Storytimes", "Application", "App", "Service") created by The Silly Bugs LLC ("We", "Us") is a multi-platform service that provides users with recording and listening to audiobooks. In particular, some of FoxStoria’ features utilize voice recording systems to create audiobooks with musical accompaniments, sound effects, and other media (collectively, the "Media").

These Terms of Use govern your use of Our service as the User. A User ("You", "Your", "User", "Users") includes all persons interacting or accessing any FoxStoria Application experience. The Application services used for finding, listening, watching, and playing Media including all functionality, websites, mobile applications, speakers, media players and all content and software are known as the “Services.”

YOUR ACCEPTANCE OF THE TERMS OF USE

Our Terms of Use includes Our Privacy Policy. By accessing, visiting, or browsing Our Services, you accept and agree to these Terms of Use. If you do not agree to these Terms of Use, do not use FoxStoria Services.

ELIGIBILITY, ACCOUNTS, AND CONDUCT

ELIGIBILITY; PARENTAL CONSENT

FoxStoria is intended to be used by parents, guardians, and educators. If you are a parent or guardian, you are responsible for your child’s use of the Services. Children under 13 should not create an account or submit personal information without a parent or guardian’s consent. If we learn that we have collected personal information from a child under 13 without appropriate consent, we will delete it as required by law.

ACCOUNTS; SECURITY

You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account. You agree to provide accurate information and to promptly update it if it changes. You are responsible for keeping your device and access to the Services secure.

You’re not allowed to copy or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages or make derivative versions. The app itself, and all the trademarks, copyright, database rights, and other intellectual property rights related to it, still belong to us.

The FoxStoria app stores and processes personal data that you have provided to us, to provide FoxStoria Service. It’s your responsibility to keep your phone and access to the app secure.

SUBSCRIPTION MEMBERS

Although certain features and/or content of the FoxStoria Service may be available at no charge to any user, other features and/or content may only be available to who agree to pay for a subscription plan (each, a "Subscription Member"). If you activate a Subscription Service, you authorize FoxStoria to periodically charge, on a going-forward basis and until cancellation of either the recurring payments or your account, all accrued sums on or before the payment due date for the accrued sums. Unless expressly stated otherwise at the time you activate the subscription service: (a) your account will be charged automatically on the subscription billing date all applicable fees and taxes for the next subscription period, (b) the subscription will continue unless and until you cancel your subscription or we terminate it, and (c) you must cancel your subscription before it renews in order to avoid billing of the next periodic subscription fee to your account. Each subscription plan may be described in more detail in other areas of the FoxStoria Service. Any payment terms displayed to you in the process of becoming a Subscription Member are deemed part of these Terms.

FREE TRIALS

Some subscription plans may include a free trial (for example, a 3-day trial on website subscriptions, as shown at checkout). If a free trial is offered, you may be asked to provide a payment method to start the trial. Unless you cancel before the trial ends, your subscription will automatically continue as a paid subscription and you will be charged the then-current recurring fee (plus any applicable taxes) when the trial period ends.

AUTOMATIC RENEWAL & BILLING

Subscriptions renew automatically at the end of each billing cycle unless canceled. You authorize us (and our payment processors, such as Stripe, Apple, and Google) to charge your selected payment method for the recurring subscription fee and any applicable taxes. If we change subscription pricing, we will provide notice where required and the new price will apply at your next renewal unless you cancel.

CANCELLATION EFFECTIVE DATE

When you cancel, your subscription will stop renewing and you will generally retain access until the end of your current paid billing period. If you cancel during a free trial, you will not be charged for the subscription unless otherwise disclosed at checkout.

SUBSCRIPTION CANCELLATION

If you subscribed to FoxStoria via the Apple App Store or iTunes, you can cancel your account anytime by going to Settings -> Apple ID-> Subscriptions and choosing FoxStoria and pressing Cancel Subscription. If you subscribed to FoxStoria via Google Play, you can cancel your account anytime on the Google Play Store by going to your account page -> Subscriptions and choosing FoxStoria and pressing Cancel Subscription. Please note that FoxStoria subscriptions purchased via the Apple App Store are governed and controlled by the terms and conditions established by Apple, and likewise subscriptions purchased via Google Play are governed and controlled by the terms and conditions established by Google.

Deleting the app or deleting your FoxStoria account does not cancel your subscription. You must cancel through the applicable store or note the cancellation instructions above to avoid future charges.

If you subscribed via the FoxStoria website, you can manage or cancel your subscription through the subscription management portal available from your FoxStoria account, or by contacting support@foxstoria.com.

REFUNDS

Subscription fees are generally non-refundable and we do not provide refunds or credits for partial subscription periods, except where required by law. If you purchased through the Apple App Store or Google Play, refund requests are handled by Apple or Google under their respective policies. If you purchased through the FoxStoria website (Stripe), please contact support@foxstoria.com and we will review your request.

OUR LICENSE TO YOU

We grant you a personal, revocable, non-exclusive, non-transferable, non-sublicensable, world-wide, license to access and use FoxStoria Service solely for personal, non-commercial purposes as permitted by these Terms and intended by us through the normal functionality of The Storytimes Service. This license to you will automatically terminate if you violate these Terms. Except for the foregoing limited license, no right, title or interest is transferred to you. We may allow you to store encrypted, cached content on your tablet, smartphone or other compatible internet-connected device. You may not transfer copies of cached content to any other device.

USER CONTENT

The Services may allow you to submit content such as text prompts, recordings, or other materials (“User Content”). You retain ownership of your User Content. You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, modify (for technical purposes such as formatting), and display your User Content solely to operate, provide, and improve the Services. You represent and warrant that you have all rights necessary to grant this license and that your User Content does not violate any law or infringe any third party rights.

AI FEATURES; SAFETY

Some features may use machine learning or AI to generate or transform content. AI-generated output may be inaccurate, incomplete, or inappropriate. You are responsible for reviewing content before sharing it with a child. The Services are not a substitute for professional advice.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE SILLY BUGS LLC, ITS AFFILIATES, OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. IN ALL CASES, OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR $100 IF YOU HAVE NOT PAID US).

INDEMNIFICATION

To the maximum extent permitted by law, you agree to indemnify and hold harmless The Silly Bugs LLC from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your User Content, your use of the Services, or your violation of these Terms.

DISPUTE RESOLUTION

Informal Resolution. Before filing a claim, you agree to try to resolve the dispute informally by contacting us at support@foxstoria.com and providing your name and account email. We will try to resolve the dispute informally within 30 days.

Arbitration Agreement (U.S. Residents). If you live in the United States, you and The Silly Bugs LLC agree that any dispute arising out of or relating to these Terms or the Services will be resolved by binding, individual arbitration and not in court, except that (i) either party may bring a claim in small claims court if it qualifies, and (ii) either party may seek injunctive or other equitable relief for alleged infringement or misuse of intellectual property.

Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The Federal Arbitration Act governs this arbitration agreement. The arbitrator may award the same damages and relief that a court can award, but only on an individual basis.

Class Action Waiver. You and The Silly Bugs LLC agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

Opt-Out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing support@foxstoria.com with the subject line “Arbitration Opt-Out” and including your name and the email address associated with your account.

Non-U.S. Users. If you live outside the United States, you may have the right to bring claims in your local courts, and this arbitration agreement may not apply to you.

APPLICATION UPDATES

We are committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.

The app is currently available on iOS and Android. System requirements may change, and you'll need to download updates to keep using the app. We do not promise that the app will always be updated for every device or operating system version. However, you agree to accept updates to the application when offered to you.

TERMINATION

Your right to use FoxStoria Service automatically terminates if you violate these Terms or any rules or guidelines posted in connection with the FoxStoria Service. We reserve the right, in our sole discretion, to terminate your access to all or part of FoxStoria Service, for any reason, with or without notice.

CHANGES TO THIS TERMS AND CONDITIONS

We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page.
